出口到美國的貨物，多少金額免稅？慢著(zhù)，這和你的標題不對啊，標題黨!其實(shí)回答金額很簡(jiǎn)單，但為什么有時(shí)貨值低于800usd仍需交關(guān)稅。
2016年2月24日，美國總統奧巴馬簽署了trade facilitation and trade enforcement act of 2015，簡(jiǎn)稱(chēng)為tftea，中文翻譯為《2015年貿易便捷與貿易促進(jìn)法》tftea book
其中將進(jìn)口免征稅金額從200美金增至800美金，免征稅金額是指符合條件的貨件其申報美元金額小于規定金額，即可免于做海關(guān)正式報關(guān)也無(wú)需繳納關(guān)稅或稅款。
這意味著(zhù)商品低于800美元可免于做海關(guān)正式報關(guān)及繳納進(jìn)口關(guān)稅，ups國際快遞、fedex國際快遞、dhl國際快遞等快遞公司知其業(yè)務(wù)也因此激增。法案由美國海關(guān)和邊境保護局于2016年3月10日實(shí)施。
美國進(jìn)口商品免稅額提高為全球企業(yè)進(jìn)入美國打開(kāi)了方便之門(mén)。此舉不僅激勵了美國消費者，也激勵了不少的電商賣(mài)家更多的考慮用快遞發(fā)貨。
該法案旨主要是加強美國海關(guān)和邊境保護局執行美國貿易法律法規的能力，簡(jiǎn)化和促進(jìn)合法貿易，禁止不合法貿易。但是這個(gè)免稅法規也是有條件和例外情況的，根據美國海關(guān)規定u.s.customs regulation 19 cfr 10.151,受此豁免的商品需要滿(mǎn)足以下條件：
?shipment must be imported byone person on one day.貨物必須由同一個(gè)人在同一天進(jìn)口，具有合理的零售價(jià)值，如口頭聲明或提單所證明的那樣。
?exemption is not allowed if cbp believes that the shipment is one of several lots covered by a single order or contract, and that it was sentseparately for the express purposeof securing free entry or for thepurpose of avoiding compliance with any pertinent law or regulation.
如果海關(guān)認為這批貨物是由一份訂單或合同所覆蓋的幾批貨物之一，而且其目的是為了能自由進(jìn)入（免稅）或避免遵守任何相關(guān)法律法規才單獨發(fā)送的，那么這種情況就不能豁免征稅。
?consolidated shipments addressed to one ultimate consignee are treated as one importation.
送達同一個(gè)最終收貨人的合并貨物將會(huì )被視為一票進(jìn)口貨物,即同一人在同一天內進(jìn)口幾票貨物加起來(lái)總額超過(guò)800美金也不能適用.
?exemption is not allowed if one or more partner government agencies require information to fulfill their regulatory requirements.
如果一個(gè)或多個(gè)合作政府機構需要信息才能實(shí)現監管的貨物不能豁免征稅（比如涉及fda部門(mén)監管的貨物不能豁免征稅）
?no alcoholic beverage,perfume containing alcohol (except where the aggregate fairretail value in the country ofshipment of all merchandisecontained in the shipment doesnot exceed $5), cigars, orcigarettes will be exemptedfrom duty and tax payment.
酒精飲料，含有酒精的香水（除非了裝運所有商品的裝運國的總體公平零售價(jià)值不超過(guò)5美元），雪茄或香煙不能被豁免征稅。
?exemption is not allowed in the case of any merchandise of a class or kind provided for in any tariff-rate quota.
屬關(guān)稅配額其中品類(lèi)的商品不能免稅（比如農產(chǎn)品屬于關(guān)稅配額的產(chǎn)品不能豁免征稅）

as a reminder, even in the case of low value shipment, cbp has the right to require a formal entryon any shipment where additional information, bonding, or protection is required. theadministrative exemption may be denied if cbp believes that the shipment was sent as a low value shipment for the purpose of avoiding compliance with any pertinent law or regulation.
即使我們申報的是低于800美金，但是美國海關(guān)依然有權要求做正式清關(guān)申報。只要海關(guān)懷疑發(fā)貨申報低貨值是為了避免遵守某些相關(guān)法律法律，該票貨物就有可能被拒絕豁免征稅。
如果你申報的的確是低于800美金，但美國海關(guān)有權懷疑你是故意低報，而對貨物重新估價(jià)，如果估價(jià)高過(guò)800美金，那么還是要征稅的。
